Personal injury: Medical malpractice led to tracheotomy

Modern medicine can often work miracles. When facing a procedure, most patients in Missouri likely have faith that their condition will be improved upon its completion rather than becoming more complicated. Unfortunately, negligence on the part of health care providers can often result in an unexpected personal injury. For example, a woman in another state was recently awarded almost $6 million in a medical malpractice lawsuit.

The plaintiff in the case was 38 when she underwent a thyroidectomy in 2014. During the procedure, she claims that the doctor damaged her throat, resulting in vocal cord paralysis. Several months after the procedure, she received a permanent tracheotomy.

As a result, she claims that she must clean the area three times a day in addition to bringing a breathing and suction machine with her everywhere she goes to maintain her airway. Additionally, she argues that she was denied employment because a potential employer described her tracheotomy as a "liability." Although she was recently awarded nearly $6 million by a jury, she will likely only see a portion of that amount due to caps West Virginia lawmakers put into place in 2003. A representative for the defendant in the case claims that he may appeal the decision.
