Personal injury: Medical malpractice leads to veteran's death

Medical care professionals have a large responsibility to patients in Missouri and across the country. In fact, their actions in the event of a crisis can be the difference between life and death and can ultimately result in a personal injury claim or even a wrongful death lawsuit. Unfortunately, the family of deceased veteran claims that the actions of nurses when the man was suffering a medical emergency constituted negligence.

The incident that led to the man's death happened in 2014. However, video footage of the events and the deposition of one of the nurses involved in the man's care was only recently released despite the attempts of the nursing home to keep the footage sealed. The video reportedly reveals an 89-year-old man calling for help six times before he loses consciousness.

In the deposition, a nursing supervisor claims that she took over chest compressions from another nurse when she entered the room. However, the video reportedly shows that CPR was not being performed, and the supervisor did not immediately begin compressions. When questioned, she reportedly told an attorney for the victim's family that she based her previous statement on what her actions would typically be in a situation like that.

Unfortunately, the man ultimately passed away but reports indicate that medical care providers at the nursing home waited an hour after the man stopped breathing to call 911. A nursing professional who reviewed the video claims she identified at least three violations, including failures to assess, respond and act. She also described the man's treatment as a "disregard for human life." In a written statement, the nursing home facility claims to be saddened by the events but points out that they occurred three years ago and that the facility is now under new leadership.

People with elderly relatives are likely well aware of the fragility of their medical condition. This knowledge is often what prompts them to place their loved one in a facility that is better equipped to meet their needs.
